Workers Compensation

If you have been injured on the job in Boston, a workers compensation lawyer at Pomykato & Pomykato is standing by and eager to hear how we can help you.

If you have been injured on the job, even if the accident was your fault, and cannot work because of your injuries, you are entitled to a weekly check while you are recovering. That sounds simple. The trouble is, however, that workers’ claims are often very complex and confusing. This is where we can help. Remember that you pay us nothing unless we are successful for you!

A few issues:

Are you being paid the right amount every week? Insurance companies often calculate your average weekly wage incorrectly or fail to include your overtime or bonus as required. Our office will see make sure that you are paid the correct amount each week.

You are entitled to more than a weekly check: You may be entitled to a monetary permanent impairment award for the permanent loss of function of any injured body parts and/or for disfigurement. You are entitled to travel expense reimbursement for medical treatment, including mileage and parking, and also to reimbursement for any medications that you may have paid for. We will see that these benefits are paid to you in full.

You have the right to choose your medical care: You do not have to go to a doctor that the insurer chooses for you for treatment, and you have the right to file a claim that forces the insurer to pay for your reasonable and related medical care.

You do not have to allow the insurer’s nurse or rehabilitation consultant to accompany you to your doctor visits or otherwise allow them to have any control regarding your medical care and treatment. We will help you to obtain all of the care and treatment that you need.

You may have the right to bring other claims: You may have the right to bring a claim against the “third party” that caused your injuries and disability, as well as pain and suffering – an element of damages not covered by worker’s compensation. You may be able to bring such a “third party” claim in addition to your existing worker’s claim, regardless of the fact that you may have already returned to work. You could lose this right, however, if you fail to take action within certain time periods. We will see to it that your third party rights are protected.

You may also be able bring a claim for Social Security Disability benefits: In many instances you may be entitled to receive a monthly Social Security Disability check in addition to your worker’s compensation benefit. Our office is experienced in the handling of Social Security Disability claims at all levels.
